The Public Gambling Act 1867 is the Gambling Law in India and is adopted for governing gambling in the country post adoption of the constitution in India. Entry 34 of the State List (i.e., List II of the Seventh Schedule) enlists Betting and gambling. The state legislature has the power to create its own laws pertaining to betting and gambling. Under Entry 62 of the State List, the state legislature has the attorney to make taxation laws on betting and gambling.

The gaming industry which comprises of regulated and unregulated gaming, is estimated at around US$60 billion. The gaming industry of India can broadly be classified into the following:

Regardless of the mounting popularity and the revenue generated by gambling and betting in India, the Indian laws and the Courts in India have been averse to any game of chance and probability.  With the enactment of The Goa, Daman and Diu Public Gambling Act, 1976., Goa has allowed gambling at five-star hotels post procuring approval and authorization of the State Government and paying specified recurring fee. On similar terms, gambling is legalized in Sikkim with enactment of Sikkim Regulation of Gambling (Amendment) 2005.

 

No law in the country directly regulates or prohibits betting activities in India. Any server outside India which is being used for betting, can be regulated through the internet intermediary compliances, cyber law due diligence requirements prescribed under the Information Technology Act, 2000.
