It was adapted post adoption of the constitution in India. The Seventh Schedule, List II (State List) of the constitution empowers the state governments to create laws pertaining to gambling and betting activities. Under Entry 62 of the State List, it also has the authority to create specialized taxation laws on betting and gambling.
